Compliance is the difference between a shipment that clears and one that sits in a port costing storage every day. For color cosmetics heading to India, Russia, or Brazil, the rules differ in detail but share one structure, and the structure is the part that catches people out.
That structure has a single line running through all three markets: the registration applicant is a local entity, not the foreign factory.
This guide covers the essentials for the three markets XinFengShang serves most.
India, CDSCO
- Authority. CDSCO, the Central Drugs Standard Control Organization, operating under the Drugs and Cosmetics Rules.
- Registration. The Indian importer applies. The foreign manufacturer is named in the registration, but it is not the applicant and cannot be.
- Timeline. Typically 30 to 60 days for a complete, correct file. Incomplete files restart the clock rather than pause it.
- Duties. HS 3304 color cosmetics carry basic customs duty around 20% plus social welfare surcharge around 2%, which lands near 22%. IGST then applies, 18% for most color cosmetics and 28% for perfume. Effective tax load can reach 30% to 56% depending on the category.
- Evidence required. Certificate of analysis, safety data sheets, full formula, artwork and labels, and stability data.
One practical note on timing. Landed cost quoted without IGST usually looks competitive and then produces margin shock at clearance. Build the full tax stack into the price before you quote your own customers.
Russia and the EAEU, EAC plus Chestny Znak
- Authority. EAC Declaration of Conformity under TR CU 009/2011. The applicant must be a Russian or EAEU legal entity.
- Mandatory marking. Chestny Znak serialization has been compulsory for cosmetics since 1 March 2026. Products without the marking cannot be listed on major marketplaces, including Wildberries and Ozon.
- Evidence required. Technical file, local representative, and test reports aligned to the applicable technical regulation.
- Strategic note. A Russian customer who acts as the EAC applicant hands you a reusable compliance template. Every later shipment follows the same path. Ask on the first order whether they can be the applicant, because the answer determines whether the relationship can scale.
Timing matters here. Chestny Znak is not a labeling preference, it is a listing requirement. Products that arrive unmarked have to be marked domestically or returned, and both outcomes cost more than getting it right at production.
Brazil, ANVISA
- Authority. ANVISA, which classifies personal care products by risk level. Lower-risk products follow a notification route and higher-risk products require registration.
- Applicant. The importer or a local legal entity applies. A foreign manufacturer cannot file directly.
- Tariff. Mercosur common external tariff rates change, so confirm the current rate for the specific HS code before quoting rather than relying on a figure from a previous project.
- Evidence required. Technical documentation, labels in Portuguese, and a locally responsible person.
If you are new to Brazil, treat the first shipment as a documentation project rather than a sales project. The paperwork is the product at that stage.
The responsibility split that saves you
| Step | Owner |
| Product registration | Local importer or local entity |
| Formula and test documentation | Manufacturer, us |
| Label localization and artwork review | Local importer |
| Serialization, Russia | Local importer |
| Market-specific claim review | Local importer with manufacturer input |
Knowing which box you own is what prevents the two most expensive compliance mistakes: assuming the factory can register abroad, and assuming the importer will handle documents the factory never produced.
The packaging route, and its limits
Cosmetic packaging is classified under separate harmonized system codes covering plastics, glass, and aluminum containers, not under finished cosmetic codes. It therefore does not carry the finished-cosmetic registration obligations that apply to the products it will eventually hold.
For a first order into an unfamiliar market, packaging moves faster and with less documentation. It is a legitimate way to start a commercial relationship and to test a supplier, and it is worth raising explicitly with a supplier rather than discovering it by accident.
The limit is straightforward. Packaging gets you a transaction, not a brand presence. The moment the plan is finished cosmetics on a shelf, the registration work above becomes unavoidable, and the local applicant question returns.
Common mistakes
- Assuming the factory can register abroad. It cannot, without a local entity.
- Skipping Chestny Znak and then discovering the product cannot be listed in Russia.
- Quoting landed cost without IGST.
- Leaving label localization until after production.
- Treating compliance as the importer’s problem alone. It is a shared file with a clear split of who produces what.
Why it matters for your brand
A compliant shipment is a repeatable shipment. Build the documentation package once with your manufacturer and the same path works for every reorder, which converts a one-off regulatory effort into an operating asset. That is the difference between entering a market and being present in one.
The takeaway
You do not need to be the applicant. You need a local partner who can be, and a manufacturer who supplies clean documents on time. Ask one question on the first call: can you be the registration applicant? The answer decides how far this market can go.
